The purpose of the processing of your Newsletter data is to keep you informed about our activities and to promote ICFC’s products and services. When you raise a query using the form provided

The personal data collected through the contact form on this Website are used exclusively to manage and respond to queries, requests or comments submitted by users. Personal data that may be collected include, but are not limited to, first name and surname, email address, telephone number, province of residence, and any other information that the user voluntarily provides in his or her message.

The purpose of collecting and processing this data is to provide an appropriate and personalised response to each query, as well as to keep a record of communications to improve the quality of customer service. The legal basis for the processing of these personal data is the adoption of pre-contractual measures requested by the user.

When applying for a job with ICFC

The personal data collected through the form provided for sending CVs on this Website, which you can find in the “JOIN THE TEAM” part of the “CONTACT” section” of the Website, are used exclusively to manage and evaluate applications for jobs available in ICFC. Personal data that may be collected include, but are not limited to, given name and surname, date of birth, email address, telephone number, postal address, work experience, educational background and any other information that the candidate provides in his/her CV and cover letter.

The purpose of collecting and processing these data is to carry out an appropriate and efficient selection process that will allow us to identify the most suitable candidates for the vacant positions. The legal basis for the processing of these personal data is the adoption of pre-contractual measures at the request of the candidate.

Personal data collected through video surveillance systems installed in our facilities are used exclusively to ensure the safety and protection of the company’s people, property and assets. Video surveillance systems only capture images and do not record sound.

The purpose of collecting and processing these images is to prevent and detect potential security incidents, such as theft, vandalism or unauthorised access, as well as to provide evidence in the event of an incident occurring. The legal basis for the processing of these personal data is the fulfilment of a mission carried out in the public interest, linked to ensuring the security of its facilities and the safety of the persons in them.

3. How long do we keep your personal data?

Your personal data are not retained longer than necessary to achieve the aforementioned purposes. In particular, the following retention periods apply:

• Browsing data: three months after your last visit.
• Newsletter data: maximum one month after you decide to unsubscribe from the newsletter (withdrawal of consent).
• Event data: three years after the end of the promotional event to carry out verification activities and to protect the interests of ICFC in relation to any liability arising from the event. This retention period may be adapted as indicated in any specific privacy notice attached to the event.
• Contact data: Your data will be retained for the duration of the contractual relationship between us, in order to respond to your queries or provide you with our goods and services.
• CV data: Your data will be kept for the duration of the selection process you have applied for, and will be deleted at the end of the process. Unless you have given us your consent to keep the data in case you wish to be informed of future vacancies that may be of interest to you, they will be kept for a maximum of two years, provided that you do not withdraw your consent.
• Video surveillance data: Your data will be kept for one month from the date on which they were collected, in accordance with Article 22 of the LOPDGDD. The images will then be destroyed unless they relate to criminal or administrative offences in matters of public security or to an ongoing police investigation.

Once these periods have elapsed, your personal data will be deleted, except where we are legally required to retain them for a longer period (for example, to comply with tax obligations) or where a problem has occurred and we have a legitimate interest in retaining them for a longer period to protect our interests, including the establishment, exercise or defence of any legal claims (for example, in the event of fraud or misuse of the Website).

4. With whom do we share your personal data?

ICFC is committed to ensuring the confidentiality of your personal data. By default, ICFC will never share your personal data with third parties outside the Ferrero Group. Also, all our employees are subject to an obligation of confidentiality.

In some cases, however, we may need to share your personal data with a limited number of people (the “Recipients”) whose participation is necessary to achieve one of the aforementioned purposes.

In particular, your personal data may be shared with the following recipients:

• Other Ferrero Group companies in the food sector that are located within the European Economic Area, so they can offer you country-specific content, for event management or for internal administrative purposes.

• Duly designated service providers and business partners, such as external IT or marketing agencies, who participate in activities related to the Website (for example, technical maintenance, web hosting, mailing list management, competition management, etc.)

• Public entities, organisations or authorities, in accordance with applicable legislation or binding orders of such entities, organisations or authorities. We may also disclose your Personal Data when we believe in good faith that such disclosure is necessary to protect your safety or the safety of others, investigate fraud, or respond to a government request.

• To another company, a law firm or an auditing firm for extraordinary corporate transactions, to perform audits, or to establish or defend a legal claim.

Wherever possible or reasonable, your personal data will not be shared with external recipients or will be shared only after they have been anonymised or pseudonymised to further protect your privacy.

Do we transfer your personal data to other countries?

As a general rule, your personal data will only be processed in the European Economic Area. However, it may be the case that one of the recipients mentioned above with whom some data must be shared is located in another jurisdiction (for example, another Ferrero Group company organising the promotional event in which you participate, a web hosting service provider located abroad, etc.). In this case, ICFC will only transfer your personal data in accordance with applicable personal data protection legislation.

In particular, if you are located in the European Economic Area (EEA) and one of the recipients of your personal data is located outside the EEA in a country that does not offer an equivalent level of data protection, ICFC undertakes to adopt an additional transfer tool and complementary measures to ensure an equivalent level of protection of your personal data in accordance with appropriate safeguards as established in Articles 44 to 50 of the GDPR. Do we process personal data of minors?

To comply with data protection legislation that protects minors, ICFC does not knowingly collect any personal data from persons under 18 years of age. ICFC takes the right of minors to data protection very seriously. Therefore, we recommend that a parent or guardian assist and guide any minor under 18 years of age who intends to browse the Website or access the services provided by ICFC. Minors under 18 years of age may not use the Website or ICFC services by themselves. If ICFC should become aware that it has inadvertently collected personal data from a child under 18 years of age, ICFC will immediately delete such information.

5. What are your data protection rights?

You have several rights in relation to the processing of your personal data:

• the right to obtain additional information or clarifications regarding the processing of your personal data, and to obtain a copy thereof;

• the right to obtain rectification of your personal data if they are inaccurate or incomplete;

• the right to object to the processing of your personal data for reasons related to your particular situation, provided that the processing is based on our legitimate interests (for example, processing for external communication purposes). In those cases in which the processing is based on the existence of a legitimate interest, you will have the right to request the weighting report prepared by ICFC. • the right to obtain from us restriction of processing (i.e. temporary suspension of processing) while we assess the validity of another request relating to your personal data;

• the right to data portability whenever you have provided us with personal data (i.e. the right to receive your personal data in a commonly used and machine-readable format and to transmit it to another Data Controller);

• the right to request the erasure of your personal data (“right to be forgotten”);

• the right to withdraw your consent, provided that your personal data have been collected or are being processed on the basis of your consent (for example, you can unsubscribe from our newsletter at any time);

• the right not to be subject to a decision based solely on automated processing, including profiling, that produces legal effects or significantly affects you. ICFC informs you that, without prejudice to its right to make decisions based on automated systems, these decisions either (i) do not produce legal or other significant effects for the data subject or; (ii) are not adopted exclusively in an automated manner.

If you believe that ICFC has not handled your request correctly or has violated applicable data protection legislation, you may file a complaint with the Luxembourg data protection authority (the Commission Nationale pour la Protection des Données), in its capacity as the main supervisory authority, or failing that, with your national or local data protection authority, in this case, the Spanish Data Protection Agency (www.aepd.es).
